First off we would like to apologize for not providing an update after day 1; yesterday was a long day and the usual authors were simply exhausted. We have waited so long for this day to arrive, and we are pleased to update you concerning the events of day 1 and day 2.

This will be a shorter update than normal and we will not be able to cover the scope of material relevant to our trial. We apologize for this, but our manpower is simply overloaded at this point as we enter the final hours before the gavel falls next Tuesday. We will briefly discuss where we are at in the litigation, but the focus of this update will be on atte nding the trial.

Leonidas Update April 26, 2009

Dear Fellow US Airways Pilots,

 

We are within hours of commencing the most important event of our careers as West pilots. Our case against USAPA will begin promptly at 9AM this Tuesay in court room 504 of the Sandra Day O’Connor Federal Courthouse. The trial is scheduled to last eight days, Tuesday through Friday of this week and the following week. It will conclude on May 8 whereupon the jury will receive their instructions and retire to deliberate.

Today both sides submitted several filings to the Court in accordance with a deadline prescribed by the March 16th Pretrial Order. All of the filings were in the normal course of pre-trial procedure. The filings cover general pre-trial matters: objections to proposed exhibits; each side’s proposed verdict; trial briefs from each side; proposed questions for prospective jury questioning (known as “voire dire”);
